Terms of Service

1. Acceptance of Terms

By creating an account on MakeEmWait ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MakeEmWait provides waitlist management software with built-in viral referral tracking. Account Holders can create waitlists, collect signups, track referrals, and send email communications to their waitlist subscribers.

3. Your Responsibilities for Collected Data

You (the Account Holder) are responsible for any personal data collected through your waitlists. This includes:

• Complying with applicable privacy laws when collecting personal data from your waitlist signups
• Informing your signups about how their data will be used
• Responding to data access and deletion requests from your signups
• Enabling the consent checkbox on your waitlists if required by applicable law

MakeEmWait processes personal data on your behalf according to the features you configure for your waitlists. We do not use signup data for any purpose other than operating the Service.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk email to people who have not opted in
• Collect personal data in violation of applicable privacy laws
• Impersonate another person or organization
• Distribute malware, phishing, or other malicious content
• Attempt to exploit, bypass, or compromise the Service's security measures
• Use the Service for any illegal purpose

5. Data Ownership

You retain ownership of all data you upload or collect through the Service, including waitlist signup data, email templates, and custom configurations. MakeEmWait does not claim ownership of your data.

You grant MakeEmWait a limited license to process your data as necessary to provide the Service (e.g., storing signup records, sending emails on your behalf, generating analytics).

6. Subscriptions and Billing

• All new accounts receive a 7-day free trial of the Pro plan with no credit card required.
• Subscriptions are billed monthly through Stripe.
• You can cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact support@makeemwait.com.

7. Account Termination and Data Deletion

• You can delete your account at any time from the Account page. This permanently removes all your data including waitlists, signups, templates, domains, and team records.
• MakeEmWait reserves the right to suspend or terminate accounts that violate these Terms.
• Upon termination, all data associated with your account will be permanently deleted.

8. Service Availability

MakeEmWait is provided on an "as is" and "as available" basis. We make reasonable efforts to maintain uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability.

9. Limitation of Liability

To the maximum extent permitted by law, MakeEmWait shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to MakeEmWait in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold MakeEmWait harmless from any claims, damages, or expenses arising from your use of the Service, including any violation of these Terms or applicable laws.

11. Changes to Terms

We may update these Terms from time to time. The version number and "last updated" date at the top will be changed accordingly. Continued use of the Service after changes constitutes acceptance.
